Martus Clothing and Everlight are trading names of a sole trader's company based in the United Kingdom.

About these terms
These terms apply when you buy anything from martusclo.store. By placing an order, you agree to them. We may update them from time to time, and the version on this page at the time of your order is the one that applies.
Our products
Everything we sell is made to order in the United Kingdom. Nothing is held in stock. This means each item is made specifically for you after you order, which is why dispatch takes a few days longer than it would from a warehouse.
Because garments are printed individually, slight variations in print position and colour are normal and are not defects. Product photography is shown as accurately as we can manage, but screens vary and colours may look slightly different in person.
Orders and contracts
When you place an order, you will receive an email confirming we have received it. This is an acknowledgement, not an acceptance. A contract between us only forms when we email to confirm your order has been dispatched.
We may decline an order if the item is unavailable, if we identify an error in the price or description, or if we are unable to obtain payment authorisation. If we decline an order after taking payment, we will refund you in full.
Prices and payment
All prices are in pounds sterling and include any applicable taxes. We are not currently VAT registered, so no VAT is charged on your order.
Delivery costs are shown separately at checkout before you pay. Payment is taken when you place your order.
We take reasonable care to make sure prices are correct, but if an item is listed at an obviously incorrect price, we are not obliged to fulfil the order at that price. We will contact you before doing anything.
Cancellations and returns
You have a legal right to cancel your order within 14 days of receiving it. Full details, including how to do it and who pays for return postage, are in our Return and Refund Policy.
Intellectual property
All designs, artwork, text, photography and the Martus name or Everlight name and logo belong to us. You are buying the product, not the design on it. You may not reproduce, copy or use our designs for any commercial purpose without written permission.
Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else which cannot legally be limited.
Subject to that, our liability for any order is limited to the amount you paid for it. We are not liable for indirect or consequential losses.
Your statutory rights as a consumer are not affected by anything in these terms.
Events outside our control
We are not responsible for delays or failures caused by events beyond our reasonable control, including courier disruption, supplier failure, or extreme weather. If such an event occurs, we will contact you and either extend the delivery timescale or offer a full refund.
Governing law
These terms are governed by the laws of England and Wales, and any disputes will be handled by the courts of England and Wales.
